Read all three parts below — Terms & Conditions, Privacy Policy, and DMCA & Copyright Policy — before using Beat Whispers. By creating an account or signing in, you agree to all three.

Terms & Conditions

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of Beat Whispers (also referred to in parts of the app as "Loop Battle") — the website, matchmaking, chat, file upload, voting, and leaderboard features (together, the "Service"), operated by Dan Mocanu, an individual based in the United Kingdom ("we", "us", "our").

By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy below. If you do not agree, do not use the Service.

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date below and, where reasonably practical, let you know through the app. Continuing to use the Service after changes take effect means you accept the updated Terms.

2. Eligibility

2.1 Minimum age

You must be at least 13 years old to create an account or use the Service.

2.2 Minors

If you are under 18, you confirm that a parent or legal guardian has agreed to these Terms on your behalf and is aware of your use of the Service.

2.3 Restricted persons

By using the Service you confirm you are not barred from receiving it under the laws of the United Kingdom or any other applicable jurisdiction (for example, under trade sanctions or export control laws).

3. Your account

You can create an account with an email address and password, or by signing in with a third-party provider (currently Discord or Google). If you sign in with a third-party provider, that provider's own terms and privacy policy also apply to your use of their sign-in service.

You agree that you will:

  • provide accurate information when creating your account;
  • keep your password confidential and not share your account with anyone else;
  • only create and use one account, unless we agree otherwise in writing;
  • notify us at beatwhispers@hotmail.com if you become aware of any unauthorised use of your account.

You are responsible for all activity that happens under your account, whether or not you authorised it, except to the extent caused by our own breach of these Terms.

4. The game

Beat Whispers is provided as a competitive, social game. Matches, Elo ratings, win counts, and the leaderboard are for entertainment purposes and are not a professional competition, a game of chance, or a form of gambling — no money or prizes change hands within the Service itself.

Your display name, avatar, Elo rating, and win count are shown on the public leaderboard and to other players in your matches. Choose a display name you're comfortable being shown publicly.

We may change, suspend, or discontinue any feature of the Service at any time. We don't guarantee uninterrupted availability — see Section 10 (Disclaimers).

5. Content you submit

5.1 Ownership and licence

"Your Content" means the beats you upload during a match and any messages you send in match or lobby chat. You keep ownership of Your Content. By submitting it, you grant us a limited, non-exclusive, royalty-free, worldwide licence to host, store, reproduce, and transmit it solely to operate the Service — for example, streaming your uploaded beat back to the other players in your match. Chat messages are delivered live and are never permanently stored; they're discarded once the match ends.

5.2 Your warranties

By submitting Your Content, you confirm that:

  • you own it, or you have all rights and permissions needed (including from any third party whose samples or sounds you used while producing it) to upload it and grant us the licence above;
  • it doesn't infringe anyone else's copyright, trade mark, or other rights;
  • it complies with the Acceptable Use rules in Section 6.

5.3 Removal

We may remove or disable access to content we reasonably believe breaches these Terms or the law, and may suspend or terminate the account of anyone who repeatedly submits infringing content — see our DMCA & Copyright Policy below.

6. Acceptable use

When using the Service, including in chat, uploads, and your player profile, you agree not to:

  • upload or send anything unlawful, defamatory, hateful, harassing, sexually explicit, or otherwise seriously objectionable;
  • upload audio you don't have the rights to use;
  • harass, bully, threaten, or abuse other players, or impersonate any person or organisation;
  • cheat, use bots or automation, exploit bugs, or otherwise interfere with matchmaking, voting, or Elo;
  • attempt to gain unauthorised access to another player's account or any part of the Service that isn't intended for you;
  • upload malware or scrape/systematically extract data from the Service;
  • use the Service for any commercial purpose without our prior written consent.

We may investigate suspected breaches and take action we consider appropriate, including removing content, issuing warnings, and suspending or terminating accounts.

7. Our content and intellectual property

Everything that makes up the Service other than Your Content — the Beat Whispers name and logo, the game's design and code, and the sample loops and drum kits we provide — is owned by us or our licensors.

We grant you a limited, personal, non-exclusive, non-transferable licence to use the Service and our loops/kits for the purpose of playing the game. You may not redistribute, sell, or commercially exploit them without our prior written permission.

8. Third-party services and links

The Service links to third-party services we don't control, including sign-in via Discord and Google, our Discord community, our Instagram page, and our Buy Me a Coffee page. Your use of those services is governed by their own terms, not ours.

Any donation made through Buy Me a Coffee is made directly to that platform under its own terms — it is a voluntary gift, not a payment for goods or services, and we don't process or store any payment information ourselves.

9. Suspension and termination

We may suspend or terminate your account if we reasonably believe you've breached these Terms or if required by law. You can stop using the Service at any time — email beatwhispers@hotmail.com to request deletion of your account and data.

10. Disclaimers

The Service is provided "as is" and "as available". We don't promise it will be uninterrupted, secure, or error-free. To the fullest extent permitted by law, we exclude all warranties about the Service, without limiting any right that can't lawfully be excluded, including your rights under UK consumer protection law.

11. Liability

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or anything else that can't lawfully be limited.

Subject to that, to the fullest extent permitted by law we are not liable for any indirect or consequential loss, and our total liability to you is limited to £100 or the amount (if any) you've paid us in the 12 months before the claim, whichever is greater. The Service is provided free of charge aside from any voluntary donation made elsewhere on Buy Me a Coffee's own terms.

12. Governing law

These Terms are governed by the laws of England and Wales, whose courts have exclusive jurisdiction over any dispute, without prejudice to any mandatory consumer protections in your own country of residence.

13. General

These Terms, together with our Privacy Policy and DMCA & Copyright Policy below, are the entire agreement between you and us. If any part is found unenforceable, the rest continues to apply. You may not transfer your rights under these Terms; we may transfer ours in connection with a reorganisation, merger, or sale, provided your rights aren't reduced.

Privacy Policy

1. Who we are

This Privacy Policy explains how we collect, use, and protect your personal data when you use Beat Whispers. The Service is operated by Dan Mocanu, an individual based in the United Kingdom. For UK data protection law, we are the "controller" of the data described below. Contact us at beatwhispers@hotmail.com.

2. Data we collect

Account data: your name and email (or, via Discord/Google, the name, email, and avatar those providers share); a hashed password if you sign up with email; your player display name.

Gameplay data: your Elo rating, win count, match history, votes cast and received, and metadata about beats you upload (file name, size, upload time).

Your Content: the audio files you upload, and chat messages — which are delivered live and never written to our database, held in memory only for the life of the match.

Technical data: an authentication session cookie, and standard connection data our hosting, database, and storage providers log automatically.

We don't use analytics, advertising, or tracking cookies, and we don't run any analytics software on the Service.

3. How we use it

To run the Service — accounts, matches, chat, Elo, and the leaderboard — because it's necessary to perform our contract with you.

To keep the Service secure and enforce our Terms, because it's in our legitimate interests to protect players.

To respond to support or copyright requests, and to comply with our legal obligations.

4. Data shown publicly

Your display name, avatar, Elo, and win count appear on the public leaderboard and to other players in your matches, whether or not you're signed in. Uploaded beats are not public — only players in that specific match can play them back, and only during the reveal, voting, and results stages.

5. Cookies

We use a single, strictly necessary cookie to keep you signed in. It isn't used for advertising, analytics, or tracking. Because it's strictly necessary, we don't show a cookie banner for it.

6. Who we share data with

We don't sell your data or share it with advertisers. We use a small number of processors: Neon (database hosting), Cloudflare R2 (audio file storage), and Railway (application hosting).

If you sign in with Discord or Google, they process what's needed to authenticate you as independent controllers — their own privacy policies apply to that part of the process.

7. International transfers

Our providers may process data outside the UK or EEA. Where that happens, we rely on the safeguards they make available to keep your data appropriately protected.

8. Retention

We keep your data while your account is active. Email beatwhispers@hotmail.com to request deletion; we'll delete or anonymise it within a reasonable period, except where we need to retain limited information for a legal obligation or dispute.

9. Your rights

Under UK GDPR you can ask us to access, correct, delete, or restrict your data, object to how we use it, or provide it in a portable format. You can also complain to the ICO at ico.org.uk.

Email beatwhispers@hotmail.com to exercise any of these — we'll respond within one month.

10. Children's privacy

The Service isn't intended for anyone under 13. If you believe a child under 13 has given us personal data, email beatwhispers@hotmail.com and we'll delete it.

11. Security

We hash passwords rather than storing them in plain text, and restrict access to uploaded audio to the players in the relevant match at the relevant stage. No method of storage or transmission is completely secure.

DMCA & Copyright Policy

1. Reporting infringement

We respect intellectual property rights and expect players to as well. If you believe content on the Service — for example, a beat played back during a match — infringes your copyright, email beatwhispers@hotmail.com with:

  • a description of the copyrighted work you believe has been infringed;
  • a description of where the infringing content appears (the match or player it's associated with, and roughly when);
  • your contact details;
  • a statement that you have a good-faith belief the use is unauthorised, and that your information is accurate.

2. Our process

We review every report we receive and may remove or disable access to the content in question. Because we're based in the UK rather than the US, this isn't a formal DMCA safe-harbor process — it's a notice-and-takedown process we run in the same spirit.

3. Repeat infringers

We may suspend or terminate the account of anyone who repeatedly infringes others' rights.
